I don't think you've mentioned, what's the status of the marriage? Separated? Filed? Or just thinking about it?

Still together but we both see it coming, selling our current house. Living in “HER” house as she had told me on occasion.

She's probably correct about the house, unless she put you on the title or something. But it sounds like you may have a claim on the cash.

It should be interesting to compare her income & expense declaration (check the form, is it signed under penalty of perjury?) with your current intel.

House is really not on my mind. Just the amount she’s been squirreling away and the growth of the retirement account. Sounds like I’m only entitled to 1/2 what she’s been putting away. But a portion of the business also could come into play.

At this point you may be entitled to half of the inheritance cash. If she commingled it with funds from her marital income it may make the whole account community property. Talk with a lawyer about it--it sounds like she's got no scruples about trying to screw you over, so you may as well play level.

Thanks all, I have $200K in my 401, with a lump sum pension of $400K I was just trying to protect mine and do what’s fair. But it starting to look like she isn’t about what’s fair. I’m going dark now, be back tomorrow with more insight.

I don't know about your state but in mine you are entitled to half of EVERYTHING, including the inheritance.

You need a lawyer, too much money on the line not to.

Yes I still have the original, she has a excellent investment guy, the account made $8900 in one month.
