Student loan

Unread postby buzzdad50 » Sat Oct 14, 2017 9:32 pm

Stbx has a relatively(compared to the rest of our assets/debts) high dollar student loan in her name.

Stbx graduated while we were still engaged. I paid off her smaller loans totaling around 5k after we married that were premarital to free up cash, but never paid on the loan in question. Her parents paid it and continue to. The loan was setup by her parents in Her name behind her back, without her knowledge (according to her).

Is this something I could be put on the hook for in case of a divorce? State is TN, marriage length 6yrs.

OP I won't take a stab at your question but will leave it for the legal beagles.

I was curious however on how yourconsultation went?

Consultation is coming up this week. I’ve got a list of questions going for the lawyer....this being one of them. Just trying to get as much information as possible beforehand.

Education stays with the student. So does the debt.

Like Trevor stated, this has "pre-marital debt" written all over it. Loan in her name, taken out while she was in school, and she finished school before you were married. I don't think you have much to worry about with this. But I would still verify with your lawyer, just make sure nothing is missed.

Student loan is hers.

Make sure you do you homework and get the proper docs. When she took them out and when she finished school along with the day you got married.

Had my consultation yesterday. My lawyer didn't even hesitate to say it's hers. It would seem this is a non-issue.

Your STBX may still make it an issue. You'll probably win, but you may have to argue about it.
