In for the fight of my life..now what?

Unread postby tradingplaces » Thu Oct 12, 2017 1:19 pm

So, after years of dealing with NJ, I knew eventually she would pull this. Out of nowhere, she says 12 yr old DS doesn't want to come to my house anymore. She filed for full custody, supervised < parenting time > for me, child support changed as such, appointment of GAL, the works. Judge denied her emergency motion for full custody, however NJ has said will "not be releasing DS for my time with him until we go to court as he doesn't want to come and she can't make him". The motion she filed is full of ridiculous accusations. All false.

My attorney says there's nothing we can do until court except document all the times I showed up but she didn't. By the time we go to court it will have been three months without seeing my son. I don't see how it's possible in this day and age to just keep your kid from the other parent. If it had been me that pulled this, I feel pretty certain I'd be in jail for kidnapping or something to that effect.

What am I supposed to do now?

You are the one who is completely justified to file an emergency motion, absolutely.

But as Tom said, you need a new attorney with a functional brain, ASAP.

Bro,
Don't react, attack,

As Tom and Lionel pointed out, new attorney is in order.

How do you find one? tell us your plan on this

every day you delay, you signal to the courts that you are ok with this arrangement, what has been done?

Can you visit your son at school to get his take on the situation? It could be that mom is telling him that you don't want to see him, not that she is keeping him away from you.

Consider this, because the Judge will:

What happens in nature when a baby critter prematurely rejects one of it’s parents?

Hopefully, the judge is a lawyer rather than a biologist.

Your kid is 12, can't you pick him up from somewhere?

And funniest post ever by FoF. I really want to have like, +1 or thumbs up buttons to push on the forum for when someone is funny.
