Last Spousal Maintenance payment made - now what?

Unread postby radar_boy » Mon Nov 20, 2017 9:10 pm

Divorced in CO Dec 2012. Permanent orders were for $4000 per month for 5 years. Made last payment... So I have two questions. First: what do I need to do at this point to show that the debt is discharged here in CO? Are there court papers to file? Second: the very scary phrase is also part of this: "Spousal maintenance shall be modifiable." She hasn't spoken to me in years so I don't know what is going on financially except she just recently (~ 6 months ago) got a job in customer service. Any idea what she can do at this point?

Hello,

Who do you need to prove this to?

Good question... I guess the answer is "no one." Unfortunately, based on the last 10+ years, I have learned to instinctively expect the worst when dealing with the ex. I guess the burden would be on her to prove I haven't paid/still owe. As for the other part of the question: any idea as to what "modifiable" could bring?

She could always go back and file a motion for modification if there was an appropriate reason. It is a common clause in your State. That’s different than saying you didn’t pay the entire amount and demand an accounting.

Did you pay her directly, like with checks or bank transfers?

What are 'appropriate reasons'? She was supposed to get a degree in fitness. She didn't. She got this customer service job recently, from what I hear from the kids. Can her lack of success be reason to extend maintenance?

Standard legal answer - It depends. But think of things like disability, or some other change in circumstances that couldn’t be anticipated.

Worry about it when it happens, enjoy the moment of writing that last check. Next month spend the money on hookers and blow.

How the kids?

Thanks for the answers, Bart!

And thanks for asking: kids are good but still bitter about their mom's decisions. They're hinting to me that "its time to end paying her..." That's pretty funny given that I wasn't asked by the courts.

Alrighty then, we’ll be here if something happens, Daddio. Don’t be surprised if things come full circle with the mother, it actually gets better when that entanglement is gone. There is a virtue signal that women sing of getting along with their ex that they think improves the hunt for the next one - maybe you’ve heard it:

I’m not like all those other women . . .
