Situation: Ex-wife wants to take 14 yr. old minor daughter to a South American country to visit emancipated older sister. Older sister is on a two-year education experience (post college humanitarian internship). Ex wants to take minor child this summer for two weeks. Emancipated child returns to US once a year.

Ex and I are American with no ties to the SA country. Only tie is older sister living there temporarily.

Ex has asked me to sign an order to get minor a passport so that she can take her to the SA country for a vacation.

Been divorced ten years. We have 50-50 joint custody. No preference to either parent. Ex recently pursued thin legal matter and was awarded tens of thousands of dollars in child support arrearages due to paperwork not being filed correctly 5 years ago. Relationship with ex was "amicable." Due to recent proceedings, relationship is now tenuous.

Can I be forced to sign the paperwork to get minor the passport? I'm uncomfortable with daughter going to SA country. And to be honest, I'm not interested in ex being the one to take her there if I weren't uncomfortable.

No, not without a court order - or, unless she talks you into it.

If you did sign the paperwork, who would have custody of the passport??

I have not signed it but she calls every day to ask when I'm going to do so.

I'm resistant to do so.

How likely would a judge/the court order me to do so, in your opinion?

So any reason, like a legit one to deny your kid this travel opportunity besides you're pizzed her mom got the better if you in a money matter?

Unless there is a good reason not to, there's a pretty good chance you'll be ordered to sign it. More money down the drain for both of you, but you do you.
If you can't be a good example, you'll just have to serve as a horrible warning.

How about this -

You agree to the passport and trip, if the mother purchases a specific type of travel insurance.

An example of that insurance is Global Rescue - but there are others who do the same thing.

What Country is the mother traveling to in South America?
