Post Scheduling of Mediation: Should my lawyer contact me?

Unread postby workdog3 » Thu Mar 16, 2017 12:49 pm

After I received my wife's response to a contested divorce filing in Florida, my lawyer suggested we schedule a private mediation to which I agreed. I received notification a couple weeks ago that the mediation is scheduled for April 18th. Since then there's been radio silence from my lawyer. Is it too early to expect her to reach out to me to devise a game plan?

For the record, I've received no guidance from her regarding overall strategy or how I should be interacting with STBX. My gut tells me to find someone else, but I'm wondering if my expectations are too high and I'm going to need to drive the strategy train regardless of who I have.

Hello,

Yes, that's a problem.

What are the issues for mediation - custody?
If there are children involved, how many and how old?
Are you living somewhere other than the home now?

Your attorney sounds like my ex attorney or any other attorney for that matter. Attorneys want their clients to be least prepared so that they can shove down what ever he can during the mediation - even it means far less than what people are entitled to.

Start with reading 'the list' to learn what you are in store for and how to play this game
Moving forward with distress behind!

Yep, you should be worried. I had to find new counsel because of lackluster performance and absolutely no knowledge of my case. I sent you a personal message. Check your inbox. Don't wait around for your lawyer to contact you start looking for new counsel asap..Be glad you learned the lesson now and not at trial.

Thanks for all the responses. I'll find another attorney pronto.

We've been separated since June 2016 and have been using a 2-5, 5-2 custody schedule for my 9 year old since. I believe the only sticking point regarding the parenting plan will be who the primary parent is for school districting purposes. She's already suggested she wants to move 30 miles away which would require 4 hours of commute time each day on days when I need to get my son to and from school. I will fight for joint primary until one of us moves at which point the parent that stays will become sole primary.

The rest of the fight will be regarding alimony and child support.

Her excuse pre-divorce filing: It would be so nice to walk to restaurants...blah, blah, blah.
Her excuse post-divorce filing: The schools are so much better there.

Keep in mind she can't afford to live there.

Hey, guess what? All public schools are equal in custody matters. She can't make an argument about school ranking. If that's the best she's got, then you've no need to mediate. Just go to Court.

Child support will be by state formula - have you run the on-line calculator to determine what you pay now?

Alimony? Does the mother work?

Here are the details on that front. viewtopic.php?f=4&t=78717

I'm trying to break my issue into different forum topics as the topic titles might help others with similar situations later on.
