Should I get Child Support from my wife?

Unread postby lotuz5 » Wed Jan 11, 2017 8:15 pm

We live in Texas.
Married for 12 years.
2 kids ( 11 and 13 years old )

My wife started working about a year ago. Since then, she threatened that she would get a divorce. She hasn't filed it yet, but 5 months ago, she moved out of the house and got her own place. Since then she has started to support herself 100%. She left the kids with me and I take care of them full time. I take them to school, I pick them up, I feed them, I help them with homework, and do all kinds of activities with them, which doesn't bother me at all. The mother doesn't help at all with nothing to take care of them. She only shows up every 2 weeks for 2 hours to play with the kids and leaves. My question is, what do you guys think? Should I make her pay Child Support? She only makes minimum wage at 2 jobs. Any suggestions?

If it isn't necessary, why rock a boat that doesn't need to be rocked?

That said, it is a right of the children to be supported by both parents.

Only advice I can give from a fellow Texan:

Read the list: http://forum.mensdivorce.com//viewtopic.php?t=13374
Make a list of your own.

File first.

She moved out, file for exclusive use of the home.

You have status quo. Follow the steps, and you can't lose.

Unless you've done this before, you have no idea.

Meanwhile, is there some reason why you shouldn't prepare??

What is the income disparity between you and your wife? How much do each of you make? CS is calculated based on time spent with each parent as well as income.

Do you NEED CS to support your kids? Is your wife the type of person who would go full nuclear if you filed with the court?
There is something to be said about letting sleeping dogs lie. But as Outis correctly pointed out, your children have a right to be financially supported by both parents to have the best life possible.

You say she has been out of the house for 5 months, clearly the marriage is over. Is not retaining a lawyer the only thing stopping you from filing for divorce?

Outis, you're right two very good points.

Precisely that is the reason of my question,

As Tom said, I have no idea what can happen,

I made about $ 60K, she just like $ 25K a year,

But for all that has happened and the way she behaved

all of this has caused many problems to the degree that I have not been able to work well

In the last six months, now I'm broke.

And it is also true that as soon as she learns of the divorce,

The monster is going to wake up.
